Court upholds Wyoming’s ban on transgender athletes


Wyoming’s transgender athlete ban, which prohibits transgender girls from competing in middle and high school girls’ sports, has not yet faced a court challenge one year after its enactment. While Wyoming Equality, the state’s largest LGBTQ+ advocacy group, had prepared for litigation, finding a plaintiff has been a challenge.

The legislation’s sponsor, Sen. Wendy Schuler, believes the ban is necessary to ensure fairness for biological girls in sports. Despite criticism that the ban unfairly targets a small number of students, Schuler stands by the legislation, citing her personal experience with Title IX as a former athlete and coach.

Governor Mark Gordon allowed the ban to become law without his signature in March 2023, prompting Wyoming Equality to consider legal action. However, no transgender students impacted by the ban have pursued litigation, with one potential plaintiff withdrawing from sports entirely.

The ban has not caused significant controversy within the Wyoming High School Sports Activities Association, as schools have followed the state statute without feedback. While opponents of the ban remain prepared for a court challenge, the lack of legal action thus far has left the legislation untested in the courts.
