Wyoming legislators are set to convene next week in Lander to discuss potential changes to the state’s public records and open meetings laws. This initiative, prioritized by the Joint Corporations, Elections, and Political Subdivisions Committee, comes in response to various concerns raised by constituents.

According to a letter from committee chairmen to the Legislature’s Management Council, issues include the effectiveness of the state’s ombudsman program, the costs imposed on requesters for public records, and the “ignorance and disregard” of transparency laws by some public officials. Senate Corporations Committee Chairman Cale Case noted the possibility of addressing concerns regarding fees and timelines, while emphasizing the complexity of a comprehensive overhaul.

A memo prepared by the Legislative Service Office highlights significant differences between Wyoming’s laws and those of neighboring states. Notably, Wyoming’s definition of public records is limited to physical documents, whereas states like Montana and Utah have broader definitions. Moreover, Wyoming lacks fixed fee structures for document requests, unlike Colorado, which has set rates.

While Wyoming’s public records ombudsman, Darlena Potter, assists in resolving disputes and educating officials, she lacks enforcement powers, leading to continued noncompliance. Lawmakers’ renewed focus on these regulations may lead to significant reforms aimed at enhancing public access and accountability in government operations. Potter is expected to address the committee during next week’s session.
