Their legal filing contends that the executive order falsely claims to uphold “bedrock American principles” while actually retaliating against the firm for its client advocacy. U.S. District Court Judge John D. Bates temporarily blocked key portions of the order soon after its issuance, shielding the firm from repercussions that would limit its operations with federal agencies.

The Trump administration, spearheaded by Deputy Associate Attorney General Richard Lawson, countered by asserting that the order aims to ensure federal contracts are aligned with national security interests. Furthermore, the administration alleged Jenner engages in discriminatory practices but did not provide evidence or allow the firm a chance to defend itself.

Jenner & Block’s stance represents a broader conflict between government authority and legal independence. Partner Adam Unikowski remarked in an Atlantic column on the implications for clients of firms that capitulate to government pressure, suggesting that loyalty to constitutional principles may resonate more with clients than opportunistic compliance.

As the legal proceedings unfold, the Northern Arapaho Tribe has expressed satisfaction with Jenner’s performance, indicating that the ongoing fight is about more than just legal contracts; it’s about upholding fundamental rights.
